1. About DroneBabu

DroneBabu is a digital platform designed to connect participants in the agricultural drone ecosystem, including farmers, retailers, Drone Service Providers (“DSPs”), certified drone pilots, service engineers, drone owners, buyers, sellers, OEMs, partners and other businesses.

The Platform may facilitate activities including:

• Agricultural drone spray service discovery and booking
• Connecting farmers with Drone Service Providers
• Pilot and service-engineer discovery and hiring
• Drone rental and hiring
• New and used drone discovery and marketplace services
• Drone spare-parts discovery
• Drone repair-service requests
• Drone loan and insurance enquiries
• Drone pilot and service-engineer certification enquiries
• DaaS/VLE and business-partner opportunities
• Other drone-related products and services introduced from time to time

Some services displayed on the Platform may be available only in selected locations or may be marked as “Coming Soon”.

2. Eligibility

You must provide accurate information and have the legal capacity to enter into a binding agreement under applicable law to use the Platform.

If you are registering or using the Platform on behalf of a company, organisation, farm, business or other entity, you represent that you have the authority to act on behalf of that entity.

DroneBabu may restrict or refuse access where required by law or where we reasonably believe that a user has violated these Terms.

3. Registration and Account

Certain Platform services require registration using a mobile number, OTP or other authentication mechanism.

You agree to:

1. Provide accurate, complete and current information.
2. Keep your account information updated.
3. Keep OTPs, passwords and account credentials confidential.
4. Not permit unauthorised persons to use your account.
5. Immediately notify DroneBabu if you suspect unauthorised account activity.
6. Use only your own identity and authorised business information.

You are responsible for activities carried out through your account, subject to applicable law.

4. User Verification

Depending on the service or role selected, DroneBabu may request documents or information such as:

• Government-issued identity documents
• PAN/GST information
• Business registration details
• Drone ownership information
• Drone UIN or other regulatory information
• Drone insurance information
• Purchase invoices
• Pilot certification information
• Service-engineer credentials
• Drone photographs/videos
• Other documents reasonably required for verification

Submission of documents does not automatically mean that the user, drone, business, pilot or service has been approved.

DroneBabu may verify information directly or through authorised third parties and may reject, suspend or request additional information where appropriate.

5. Marketplace and Third-Party Services

DroneBabu may provide a platform through which users can discover, enquire about, book, purchase, rent, hire or otherwise interact with third-party products and services.

Unless expressly stated otherwise, DroneBabu is not the manufacturer, owner, seller, lessor, repairer, pilot, DSP, insurer, lender or certification authority providing the underlying third-party product or service.

The actual provider may be responsible for:

• Product quality
• Product specifications
• Availability
• Pricing
• Delivery
• Warranty
• Repair quality
• Service execution
• Certification
• Regulatory compliance
• Insurance
• Refunds or cancellations
• Other obligations relating to its product or service

Users should independently review the applicable provider’s terms before completing a transaction.

6. Drone Spray Services

Where DroneBabu facilitates agricultural drone spray bookings, the Platform may help connect farmers/customers with available DSPs or pilots.

Actual spray operations are subject to:

• Weather conditions
• Field accessibility
• Drone availability
• Pilot availability
• Applicable aviation regulations
• Applicable agricultural regulations
• Chemical/product instructions
• Local restrictions
• Safety requirements
• Operational feasibility

The user is responsible for providing accurate information regarding the farm, crop, acreage, location and intended spraying requirements.

DroneBabu does not guarantee that a particular spray request will always be fulfilled or that a specific DSP or pilot will be available.

7. Responsibility for Agricultural Chemicals

Users must ensure that any pesticide, fertiliser, biological product or other agricultural input used during a spray operation is legally permitted and appropriate for the intended use.

Users must comply with applicable product labels, agricultural regulations, safety instructions and directions of authorised professionals.

DroneBabu does not provide agricultural, pesticide, crop-protection or medical advice merely by displaying information on the Platform.

8. Pilots and Service Engineers

Where pilots or service engineers are listed on the Platform, DroneBabu may display information based on the documents and information submitted by them.

Users must verify suitability for their particular requirement.

Pilots and service engineers are responsible for maintaining the licences, certificates, permissions, qualifications and other authorisations required for the services they provide.

DroneBabu does not guarantee the performance, skill, availability or conduct of any individual pilot or service engineer.

9. Drone Sales, Rentals and Used Drones

For new or used drones, rental services or other equipment listed through the Platform:

• Users must review specifications before committing to a transaction.
• Sellers must provide truthful information about ownership, condition and specifications.
• Buyers/renters should conduct appropriate due diligence.
• Ownership, possession and transfer must comply with applicable law.
• Required registrations, permissions, insurance and regulatory requirements remain the responsibility of the relevant party.

For used drones, DroneBabu does not guarantee that a particular drone will be free from defects unless expressly stated in writing.

10. Drone Repair Services

DroneBabu may facilitate repair requests between customers and service engineers or repair partners.

Repair estimates, turnaround time, spare-part availability and final charges may vary.

Additional repair requirements discovered during inspection may result in additional charges, subject to the applicable service provider’s approval process.

Users should maintain appropriate backups of any data stored on equipment before handing equipment over for repair.

11. Pricing and Payments

Prices displayed on the Platform may be provided by DroneBabu or by third-party service providers.

Prices may change due to:

• Distance
• Farm size
• Service requirements
• Availability
• Equipment
• Labour
• Spare parts
• Taxes
• Government charges
• Other applicable costs

Where online payment is available, payments may be processed through third-party payment gateways.

DroneBabu does not store or directly process sensitive payment credentials except as permitted through authorised payment service providers and applicable law.

Any applicable GST, taxes, transaction fees or other statutory charges may be added to the displayed price.

12. Cancellation, Refunds and Disputes

Cancellation and refund conditions may vary depending on the service, product or third-party provider.

Before confirming a transaction, users should review the applicable cancellation and refund terms.

Where DroneBabu facilitates a transaction involving a third-party provider, the refund may be subject to the provider’s applicable policy.

DroneBabu may assist users in resolving transaction-related issues but does not guarantee a particular outcome.

13. User Responsibilities

You agree not to:

• Provide false, misleading or fraudulent information.
• Impersonate another person or organisation.
• Create multiple fraudulent accounts.
• Upload documents that belong to another person without authorisation.
• Upload malicious software or harmful content.
• Attempt to gain unauthorised access to the Platform.
• Interfere with Platform operations.
• Use automated systems to scrape or collect Platform information without permission.
• Manipulate ratings, reviews or bookings.
• Use the Platform for unlawful purposes.
• Infringe another person’s intellectual-property rights.
• Upload content that is unlawful, defamatory, obscene, threatening, hateful or otherwise prohibited by applicable law.
• Circumvent Platform security or verification mechanisms.
• Use the Platform to conduct fraudulent transactions.

Users must comply with applicable laws and regulations while using the Platform.

14. User-Generated Content

Users may submit photographs, videos, reviews, documents, listings, descriptions, comments and other content (“User Content”).

You represent that:

1. You have the necessary rights to submit the content.
2. The content is accurate to the best of your knowledge.
3. The content does not violate applicable law.
4. The content does not infringe third-party rights.

By submitting User Content, you grant DroneBabu a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, display and use such content for operating, improving and promoting the Platform, subject to our Privacy Policy and applicable law.

DroneBabu may remove or restrict content that violates these Terms or applicable law.

15. Ratings and Reviews

Users may be permitted to rate or review products, services, pilots, DSPs, engineers or other Platform participants.

Reviews must be genuine and based on actual experiences.

Users must not:

• Post fake reviews.
• Manipulate ratings.
• Accept payment for misleading reviews.
• Threaten or harass another user through reviews.
• Publish confidential or personal information about another person.

DroneBabu may remove reviews that violate these requirements.

16. Intellectual Property

The Platform and its contents, including but not limited to:

• Logo
• Brand name
• Website design
• Text
• Graphics
• Software
• User interface
• Database structure
• Images
• Videos
• Platform features
• Trademarks

are owned by or licensed to DroneBabu and are protected by applicable intellectual-property laws.

You may not copy, reproduce, modify, distribute, sell, license, reverse engineer or commercially exploit any part of the Platform without prior written permission.

17. Third-Party Links and Services

The Platform may contain links, integrations or references to third-party websites, applications, payment gateways, insurance companies, financial institutions, OEMs, training providers and other service providers.

DroneBabu does not control and is not responsible for the content, availability, privacy practices, security or terms of third-party services.

Your use of third-party services may be governed by separate terms and policies.

18. Accuracy of Information

DroneBabu makes reasonable efforts to keep Platform information accurate and updated.

However, information may occasionally contain errors, omissions, outdated information or third-party supplied information.

DroneBabu does not guarantee that all Platform information will always be complete, accurate, current or error-free.

19. Availability of the Platform

We may modify, suspend, discontinue or restrict any part of the Platform at any time.

The Platform may occasionally be unavailable because of:

• Maintenance
• Technical failures
• Internet connectivity
• Third-party service failures
• Cybersecurity incidents
• Force majeure events
• Regulatory requirements
• Other circumstances beyond our reasonable control

20. Limitation of Liability

To the maximum extent permitted by applicable law, DroneBabu shall not be responsible for indirect, incidental, special, consequential or punitive losses arising from:

• Use of third-party products or services
• Acts or omissions of DSPs, pilots, engineers, sellers, buyers or other users
• Product defects
• Service delays
• Weather conditions
• Crop or agricultural outcomes
• Equipment failure
• Loss of business
• Loss of profits
• Unauthorised conduct by third parties
• Information supplied by users or third parties
• Temporary Platform unavailability

Nothing in these Terms shall exclude or limit liability that cannot legally be excluded or limited under applicable law.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless DroneBabu, its affiliates, directors, employees, representatives and service providers from claims, losses, liabilities, damages, costs and expenses arising from:

• Your breach of these Terms
• Your unlawful use of the Platform
• Fraudulent or misleading information provided by you
• Your User Content
• Your violation of third-party rights
• Your transactions or dealings with other Platform users
• Your violation of applicable laws or regulations

22. Suspension and Termination

DroneBabu may suspend, restrict or terminate your account or Platform access where:

• You violate these Terms.
• You provide false information.
• You engage in fraudulent activity.
• You misuse the Platform.
• Your conduct creates a safety, legal or security risk.
• Required by law or regulatory authorities.

Where appropriate, DroneBabu may provide notice before taking such action.

Termination does not affect rights or obligations that accrued before termination.

23. Privacy

Your use of the Platform is also governed by the DroneBabu Privacy Policy.

The Privacy Policy explains how we collect, use, store, process and protect personal information.

By using the Platform, you acknowledge that you have read the applicable Privacy Policy.

24. Communications

By registering or using the Platform, you may receive transactional communications such as:

• OTPs
• Booking confirmations
• Service updates
• Payment notifications
• Cancellation notifications
• Account notifications
• Important Platform communications

Marketing communications will be handled in accordance with applicable law and available user preferences.

25. Regulatory Compliance

Users must comply with all applicable laws, rules, permissions and regulatory requirements relating to drones, aviation, agriculture, pesticides, businesses, taxation, consumer transactions, data protection and other applicable activities.

Nothing on the Platform should be interpreted as permission to operate a drone or conduct any activity that requires a licence, registration, approval or government authorisation.

26. Force Majeure

DroneBabu shall not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, severe weather, war, civil unrest, government restrictions, strikes, internet or telecommunications failures, cyber incidents, epidemics, infrastructure failures or other force majeure events.

27. Changes to These Terms

DroneBabu may update these Terms from time to time.

Updated Terms will be published on the Platform with a revised “Last Updated” date.

Your continued use of the Platform after the updated Terms become effective constitutes acceptance of the revised Terms, subject to applicable law.

28. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India.

Subject to any mandatory consumer or statutory rights available to users under applicable law, disputes arising from these Terms or use of the Platform shall be subject to the jurisdiction of the courts having appropriate jurisdiction over Gurgaon, Haryana, India.

30. Severability

If any provision of these Terms is determined to be invalid, unlawful or unenforceable, the remaining provisions shall continue to remain in effect to the extent permitted by law.

31. Entire Agreement

These Terms, together with the Privacy Policy, applicable service-specific terms, cancellation/refund policies and other policies published on the Platform, constitute the agreement between you and DroneBabu regarding your use of the Platform, unless a separate written agreement applies.
